About Defect

DEFECT is a premium real-time 3D animation studio providing services including but not limited to: game cinematics, original IP, music videos, anime, visual design, brand films, and photography. All services are subject to separate written agreements, proposals, or service contracts.

Client Projects & Deliverables

All client work is governed by individual agreements, proposals, or contracts. Unless otherwise specified in writing: ownership of final deliverables transfers to the client only after full payment; Defect retains the right to showcase completed work in portfolios, case studies, and marketing materials unless agreed otherwise; and any third-party tools, plugins, licenses, or platforms remain subject to their respective terms.

Payments & Fees

Payment terms, deposits, and schedules are outlined in individual client agreements. Unless otherwise stated: deposits are non-refundable; late payments may result in project delays or suspension of services; ongoing services may be paused if invoices remain unpaid; and Defect reserves the right to suspend or terminate services in the event of non-payment.

Limitation of Liability

To the maximum extent permitted by law: Defect shall not be liable for indirect, incidental, or consequential damages; we do not guarantee specific business outcomes, revenue increases, or performance metrics; and we are not responsible for third-party platform outages, hosting failures, or software changes beyond our control. All services are provided as is and as available.

Third-Party Services

Our website and client projects may integrate third-party services such as hosting providers, payment processors, analytics tools, or other platforms. Defect is not responsible for the policies, availability, or performance of third-party providers.

Confidentiality

We respect the confidentiality of client information.

Where applicable, confidentiality terms are governed by separate agreements or NDAs.

Termination

We reserve the right to:

  • Suspend or terminate services for breach of contract

  • Refuse service at our discretion

  • Remove access to digital assets in cases of non-payment (subject to contract terms)

Governing Law

These Terms & Conditions are governed by and interpreted in accordance with the laws of Florida, United States. Any disputes arising from these Terms shall be subject to the applicable state or federal courts located in Florida.
